User agreement
Website Administrator of polis24.kz — Generate LLP | BIN 090940017637
Version dated 15 October 2026
1. General terms
This User Agreement governs access to and use of the website https://polis24.kz/, administered by Generate LLP, Business Identification Number (BIN) 090940017637 (hereinafter the Administrator).
A User is an individual or a representative of a legal entity who uses the website, application forms, calculators, personal account (where available), communication services and insurance support services.
This Agreement sets out the terms of use of the digital service. It is not a separate insurance contract and does not establish an insurance company's obligation to make a payment. An insurance contract is concluded with the insurer on the terms of the relevant insurance product.
2. Website features and limits of authority
The website may provide insurance information, calculators, requests for and comparisons of offers, submission of applications, arrangement of policies through an authorised insurer, document viewing, and enquiries concerning renewal and insured events. The specific features are determined by the interface actually available.
The Administrator operates as an insurance agency within the scope of a valid agency agreement with an insurance company and may conclude or support insurance contracts only within the relevant authority.
The User may request information about the insurer, insurance rules and the agency's authority. The insurer makes the final decision on risk acceptance, rates, exclusions and insurance payments in accordance with legislation and the contractual terms.
Indicative calculations are preliminary until confirmed by the insurer. Calculator results do not guarantee risk acceptance or the final insurance premium.
3. Acceptance and confirmation of actions
Use of publicly accessible information sections entails an obligation to comply with the applicable access terms; neither the conclusion of a separate insurance contract nor consent to personal data processing may be inferred solely from viewing pages.
To submit an application, the User confirms acceptance of the applicable interface terms and separately gives consent to data processing and transfer to insurers. Acceptance of this Agreement is recorded through a separate action (ticking a box and submitting a form, registration or another verifiable method).
Where a personal account is available, registration follows the procedure established by the website. The User must keep their login, password and codes confidential and promptly report any suspicious access.
4. User obligations
Provide accurate and up-to-date information necessary to assess the insurance risk and conclude a contract; bear in mind that inaccurate material information may have consequences under the Civil Code of the Republic of Kazakhstan and the insurance rules.
When providing information about another person, have the relevant lawful authority, consent or another statutory basis, and refrain from uploading information that is clearly unnecessary for the insurance purpose.
Do not use the website for unlawful data collection, interference with the server, fraud, distribution of malicious files or infringement of others' rights; do not circumvent technical restrictions.
Before arranging insurance, review information about the insurer, selected risks, insurance coverage, deductibles, exclusions, validity periods, payment procedures and termination terms.
5. Administrator obligations and rights
Provide access to information about service features and communication channels, take reasonable measures to protect the information provided, forward insurance enquiries to the appropriate recipient, and provide status updates within the scope of the information received from the insurer.
Correct technical errors and restrict access where misuse, a breach of law or a security risk is suspected, without unjustifiably infringing the rights of a User acting in good faith.
The Administrator may change the website's content and features, but changes to data processing rules and existing contractual rights must comply with the law and, where necessary, require renewed consent.
6. Insurance, documents and payments
Before submitting an application, the User selects an insurance product and, where necessary, completes a questionnaire. The information is sent to the insurer for review, rate calculation and preparation of the contract. The contract comes into existence in the manner specified in its terms and by law.
The insurance premium is paid to the insurer or an authorised intermediary using the details specified in the payment interface. The amounts and time limits for premium refunds, cancellations and adjustments are determined by applicable law and the documents of the specific contract.
Electronic documents, confirmations and notifications are sent using established methods (personal account, email or other agreed channels); the legal validity of an individual electronic document is determined by applicable legislation and the manner in which it is executed.
If an event showing signs of an insured event occurs, the User must comply with the time limits and procedure for notifying the insurer specified in the policy and insurance rules. An enquiry submitted through the website does not replace notification to the insurer unless this channel is specified as an appropriate means of notification.
7. Personal data and permission to transfer data to insurers
The data processing procedure is set out in the website's Privacy and Personal Data Processing Policy. Services requiring identification or submission of a questionnaire to an insurer may be provided after separate, verifiable consent has been obtained from the User and other data subjects, where required.
With separate consent, the Administrator transfers data concerning identity, the insured object, risks, documents, the conclusion and performance of the contract, and insured events to insurance companies — for obtaining quotations, underwriting, arranging, renewing, amending and terminating insurance, considering claims and organising payments.
The User understands that more than one insurance company may receive the information if the User requests a comparison of offers. Data is transferred only to the extent necessary for the relevant application, in compliance with insurance secrecy and other legally protected confidentiality requirements.
This Agreement does not in itself replace specific consent to the disclosure of insurance secrecy where such written consent is required under Article 830 of the Civil Code of the Republic of Kazakhstan. Advertising communications also require separate consent.
8. Example of separate consent text displayed in an insurance form
«I, [full name of the data subject], consent to the collection and processing by Generate LLP, BIN 090940017637, of the personal data I have provided for consultation, obtaining insurance offers, calculating rates, arranging and supporting insurance, and settling insured events. I authorise the transfer of the necessary data to insurance companies with which Generate LLP interacts within its authority as an insurance agent, including transfer to several insurers to obtain offers, and to persons lawfully involved in insurance servicing. The list of data and the processing procedure are defined in the Policy. Consent remains valid until the processing purposes have been achieved and the associated statutory retention periods have expired. Public disclosure of the data is not permitted; cross-border transfer without a separate lawful basis and the necessary consent is not envisaged. I am aware of my rights to access and correct data and to withdraw consent within the limits of the law».
Where health information or third-party information is provided, or cross-border transfer, disclosure of insurance secrecy or advertising communications are involved, the necessary separate confirmations and consents are required. In the actual form, the data subject's full name must be inserted or be unambiguously ascertainable from the verified application.
9. Intellectual property and permitted use
The website's software code, interface, trademarks, texts and databases are protected by law to the extent that the Administrator or rights holder holds the relevant rights. The User is granted a limited ability to use the interface for personal and lawful business purposes, without any transfer of exclusive rights.
Bulk copying, scraping in breach of website restrictions, reverse engineering and commercial use of materials without the appropriate permission are prohibited unless expressly permitted by legislation.
10. Liability and limitations
The Administrator is liable for its own unlawful actions to the extent determined by the legislation of the Republic of Kazakhstan. No provision of this Agreement excludes liability that cannot be limited by law.
The Administrator does not guarantee uninterrupted website availability during communication failures, scheduled maintenance or circumstances beyond its reasonable control, but takes proportionate measures to restore the service.
The Administrator does not assume the insurer's obligations to compensate for insured losses; those obligations are borne by the insurer specified in the policy. This does not release the Administrator from liability for its own violations when acting as an agent.
11. Enquiries, disputes and amendments to the Agreement
Enquiries concerning website operation and personal data processing should be sent using the contact details at the end of this document. Wherever possible, disputes are resolved through negotiation; if agreement cannot be reached, they are resolved by a court or competent authority in accordance with mandatory rules on jurisdiction and consumer protection.
The Administrator may publish new versions of this Agreement on the website. Changes do not apply retrospectively to existing contractual rights unless otherwise provided by law; new data processing terms requiring consent apply only after such consent has been obtained.
12. Term
This Agreement applies from the date of the User's acceptance and for the duration of their use of the service; provisions concerning intellectual property rights, liability, dispute resolution and confidentiality continue to apply after use ceases to the extent permitted by law.
